Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of the Product after any changes constitutes your acceptance of the new Terms.

Product Description

The Product provides digital design assets in the form of code blocks. These blocks are pre-designed components that can be integrated into your web projects.

Intellectual Property 

The Product is the property of Konsenz. By purchasing SportyBlocks, you are granted the rights described in our license.

Intellectual Property Infringement Claims

You acknowledge and agree that in the event of any third party claim that SportyBlocks infringes that third party's intellectual property rights, Konsenz d.o.o. ("Konsenz") will be responsible for the investigation, defense, settlement and discharge of any such infringement claim.

Konsenz’s obligations to defend and indemnify you for a particular claim are subject to the following conditions:

1. You must promptly give Konsenz written notice of the claim.
2. You must indicate how you or your products utilize SportyBlocks.
3. You must provide Konsenz with all information you have regarding the claim and cooperate when Konsenz defends or attempts to settle the claim.

Konsenz will have no obligation to defend or indemnify you concerning any claim that is based on or attributable to any of the following:

1. Modifications made to SportyBlocks by anyone other than Konsenz.
2. The combination or use of SportyBlocks with other products, processes, or materials not supplied by Konsenz or specified in our documentation as being necessary.
3. Your continued engagement in infringing activities after you were notified of the infringement or after Konsenz informed you of a modification or workaround that would have avoided the infringement.
4. Your use of SportyBlocks in a manner not permitted by our Terms.

You will have the burden of showing that indemnification is required.

Except as expressly stated in this section, Konsenz has no obligation or liability to you for any actual or alleged infringement related to SportyBlocks.

Purchases and Delivery

Upon completing your purchase, you will be able to create an account on our website. This account will provide you with access to download our digital blocks. As these are digital goods, no physical items will be shipped.

You are responsible for maintaining the confidentiality of your account credentials and download links. You agree that our obligation to provide the digital product is complete once we have enabled access to the downloads through your account.

Accounts

To access and download our products, you will need to create an account on our website. When you create an account, you guarantee that:

1. You are above the age of 18
2. The information you provide is accurate, complete, and current at all times

We may, at our discretion, provide updates to our design blocks. These updates may include bug fixes, new features, or compatibility improvements. You are responsible for implementing any updates.

While we strive to provide assistance, we do not guarantee extensive technical support. Any support or consultation beyond basic usage questions may be subject to additional fees.

Reserved Rights

Konsenz reserves all rights not expressly granted to you in these Terms. This includes, but is not limited to, the right to modify, update, or discontinue any aspect of the Product at any time without prior notice.

Disclaimer

Your use of the Product is at your sole risk. The Product is provided on an "AS IS" and "AS AVAILABLE" basis. The Product is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

The Product may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Termination

We may terminate or suspend your account and access to the Product immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Product will immediately cease. If you wish to terminate your account, you may simply discontinue using the Product and contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
